National Rule (U.S. EPA Amendment to 1998 Rule)

The anticipated compliance date remains January 1, 2011

Anticipated limits for Rust-Oleum and Zinsser products are:

  • Industrial Maintenance: 340 g/l

  • Rust-Preventives: 400 g/l

  • Varnishes: 350 g/l

  • Stains: 250 g/l

  • Fire Resistive Coatings: 350 g/l

  • Faux Finishing Coatings: 350 g/l

  • Floor Coatings 250 g/l

  • Specialty Sealer, Primers and Undercoaters: 350g/l

  • Shellacs (clear): 730 g/l

  • Shellacs (opaque): 550 g/l

  • Waterproofing Sealers: 250 g/l

  • Waterproofing Concrete and Masonry Sealers: 400 g/l

  • Wood Preservatives: 350 g/l

  • Low Solids Coatings: 120 g/l

  • High Temperature Coatings: 420 g/l


Illinois
The Illinois rule (based on OTC rule) became effective July 1, 2009.

Indiana
The Indiana rule has been anticipated to have an effective date of January 1, 2011.

Ohio
The Ohio rule (based on OTC rule) became effective January 1, 2009.

Massachusetts
The rule became effective January 1, 2009.

Rhode Island
The Rhode Island rule (based on OTC rule) became effective July 1, 2009.

Canada
The anticipated Canadian rule, also based on OTC rule, will not be effective until December 9, 2010.

California
Ventura County
Ventura County has proposed adopting the new amended CARB suggested control measure as of January 1, 2010.

Bay Area
The Bay Area Air Quality Management District (San Francisco area) has proposed adopting the CARB SCM as of January 1, 2011.

San Joaquin Valley
The San Joaquin Air District has been reviewing the CARB SCM and the SCAQMD rule 1113, but has not yet decided on an amendment to their current rule.

South Coast Air Quality Management District
The SCAQMD has passed Rule 1143 which regulates paint thinners and multi-purpose solvents for consumer and institutional uses. Industrial maintenance products are excluded from the rule. As of January 1, 2010, the VOC limit for consumer brand paint thinners and multi-purpose solvents will be 300 g/l. This will go down to 25 g/l on January 1, 2011. Acetone is exempt and there is a limit of 0.1% on the amount of methylene chloride that can be in the products. It is expected that CARB will have an identical rule with dates one year later than SCAQMD rule 314.

OTC States
The Ozone Transport Commission consists of the following states and district:

Connecticut
Delaware
District of Columbia
Maine
Maryland
Massachusetts
New Hampshire
New Jersey
New York
Pennsylvania
Rhode Island
And the northern counties of Virginia.
Only Vermont does not have a current or pending AIM rule.

LADCO States
The Lake Michigan Directors Air Consortium consists of the following states:

Indiana - will follow the OTC rule expected January 1, 2011
Illinois - follows the OTC rule
Michigan
Ohio - follows the OTC rule
Wisconsin
Only Michigan and Wisconsin do not have current or pending rules.

States other than California (by air district) and those OTC and LADCO states which have adopted their own rules are subject to the current U.S. EPA rule limits.
